The lawyer for accused child molester John Burbine has asked a judge to dismiss eight of the 100 charges his client is facing, saying his own client reached a "level of deviancy and perversion" unanticipated by the law, given the very young age of the victims from Melrose and neighboring communities. Attorney Bill Barabino has filed a motion to dismiss six counts of aggravated rape of a child and two counts of dissemination of matter harmful to minors. This would still leave Burbine facing some 92 counts. His wife, Marian, faces additional charges of reckless endangerment of a child for operating an illegal day care center in Wakefield where many of the victims' families were clients. Marian Burbine, the wife of accused serial child molester John Burbine, now has an expected trial date of Aug. 9. She faces six counts of reckless endangerment of a child, and two counts of operating an unlicensed day care business. Meanwhile, John Burbine is facing nearly 100 charges for allegedly sexually assaulting children from the Melrose area. Appearing with his client at a Wednesday afternoon hearing at Middlesex Superior Court, attorney John Ruehrwein told the court that he was seeking additional time because of the large amount of evidence associated with the case. As promised last month after news of the John Burbine sex abuse case—which involved Melrose area children allegedly being sexually abused—first broke, state lawmakers are introducing a bill aimed at closing loopholes in the sex offender registration system. A Thursday report on MyFoxBoston says that State Senate Minority Leader Bruce Tarr will introduce a bill Friday that would allow Level 1 sex offender information to be made public, and which would also an offender to be reclassified if new information came up about them. Marian Burbine made a brief court appearance on Thursday morning, largely to set the terms of her ongoing home confinement in connection with the child sex abuse case against her husband John Burbine. Burbine and her husband operated the former Waterfall Education Center in downtown Wakefield, and also offered tutoring and day care services that would reportedly often take place at the children's homes. Her husband had been classified as a Level 1 sex offender back in 1989, which has touched off a separate legislative debate over how to reform the current system used to share information on sex offenders. Wakefield resident John Burbine pleaded not guilty to nearly 100 child sex abuse charges at his arraignment Wednesday morning in Middlesex Superior Court in Woburn. Burbine, 49, was arrested earlier this year and charged with numerous abuse violations involving children primarily under the age of 3. Burbine spent much of the hearing looking straight ahead behind glass in a separate room, answering questions primarily with one-word responses. Unlike in the booking photo released by the District Attorney's office earlier in the month, his hair was almost completely white, with black eyebrows. The Wakefield man at the center of one of the worst child sex abuse cases in recent memory will be arraigned Wednesday morning at Woburn Superior Court. Burbine, 49, faces a total of 95 charges stemming from the alleged abuse of children receiving day care or tutoring services from his wife's business - which was not completely registered. Marian Burbine, 46, will make her own court appearance on Dec. 20 for a pre-trial hearing.
